the x86 patents for 486, x86-64 and amd64 have expired 
according to google gemini 

so according to chatgpt 
it would be possible to build a functioning x86 cpu 
with those expired patents 

but the patents for avx and other functionality has not expired 
according to google gemini 

and according to chatgpt there are some projects 
like vortex86 and opensoc86 

patents in usa usually expire after 20 years 
so chinese companies could develop and produce a x86 cpu 
and sell it on the international markets 
completely legal 

but that cpu could possibly have limited functionality 
unless the companies involved 
develop or buy their own technology 
to give the cpu more functionality 

microsoft windows is made from technology consisting of many patents 
and as the product is continually developed, more patents are added 
but as patents in usa expire after 20 years 
it's interesting to note that 
windows 1.0 was released 1985 
and windows 95 was released 1995

but it would probably take a lot of reverse engineering 
for another company to make a windows product that works

both private and business customers 
probably prefer to buy x86 cpu from intel and amd 
and windows from microsoft 
but since those customers have invested a lot of money 
into software and hardware in the x86 windows ecosystem 
and a lot of time and effort into training 
then those customers 
would probably like if there were functioning open source alternatives 
to both x86 hardware and windows software 
so that those customers had alternatives 
if intel, amd or mictosoft discontinued their x86 windows products 
or even worse if intel, amd or microsoft went bankrupt
